Attorneys practicing in the area of construction law encounter their own unique types of ethical issues. The more common ethical issues will be addressed in this topic. This material will provide a basis for identifying conflict issues that may not be obvious and discuss alternatives to avoid the issues. In negotiations, the duty of truthfulness and honesty is sometimes subject to the desire to obtain the best result for the client. This topic will discuss the duties of truthfulness generally, and how they are subject to obligations of confidentiality and privilege. There will also be a discussion of what actions can be taken when the client is acting dishonestly. A common complaint about attorneys is the lack of communication. This material will discuss the duties the attorneys have to keep the client informed.
