This topic will provide an overview of the entire process required for commercial real estate loan transaction closings. Explanation of the documentation from an attorney's perspective, what the documentation consists of, and why it is necessary will be discussed. Individuals involved in all aspects of commercial real estate will benefit from a better understanding of what is involved in closing a commercial real estate loan transaction and a more thorough understanding of the documents which may be necessary in connection therewith.

Topics Covered

This program covers three main topics:

  • Loan documentation — including everything required to demonstrate financing for a commercial transaction. This can include loan and mortgage agreements, assignment of rents and more. Students learn what red flags to look for and what constitutes appropriate due diligence in these matters.
  • Title and surveying issues — including how to read a title document, what the different types of surveys are and when they should be performed, and other topics relating to liens, zoning and land use.
  • Miscellaneous issues not covered in the first two modules, such as authority documentation, insurance, environmental reports and more.
