Leave and ADA Update During COVID-19: Overview of Various Leave Laws and the Americans with Disabilities Act

Understand the Americans with Disabilities Act and how it affects each stage of employment, from recruiting and hiring through termination.

During the COVID-19 pandemic, employers have faced an onslaught of complicated leave issues. In response to the pandemic, Congress passed the Families First Coronavirus Response Act (FFCRA) which provide new leave rights to millions of employees. During this topic, we will discuss the intricacies of the FFCRA. We will also discuss the existing Family & Medical Leave Act and issues surrounding the definitions of a serious health condition and intermittent leave. We will explore the Americans with Disabilities Act (ADA) and discuss the interactive process and reasonable accommodations versus undue hardships. Next, we will discuss various state leave laws and the impact of those laws on the workplace. Finally, we will discuss the complicated interplay of these leave laws.
