Understand how to establish paternity in the eyes of the court.
Recent estimates show that about 40 percent of births in the United States occur outside of marriage, up from 28 percent in 1990. If the parents of a child are not married at the time a child is born, paternity must be established before a man is deemed to be the legal father. Various rights, responsibilities and benefits follow a paternity adjudication. This program will help family law attorneys understand the practical nuts and bolts of establishing and proving parentage. As a result, you will be able to identify the statutory presumptions of parentage (including marital status, genetic test results and other factors) and understand how competing presumptions are resolved by the court. In addition, you will learn about the Uniform Parentage Act and the potential application of parentage laws to situations involving same-sex couples and/or assisted reproductive technology.
