Typical Title Problems

 
Numerous judicial and non-judicial remedies are available to fix title problems before or after closing. Depending on the problem, it may be necessary to fix the title problem before closing; or it may be possible to use a letter of undertaking to fix the title problem after closing, with or without an escrow. The first step in dealing with a title problem is to identify the problem. After the problem is identified, the applicable method to cure the problem must be identified and implemented.

Title problems can be grouped into about six broad categories. They are: (1) errors in recorded documents; (2) missing documents; (3) abstracting errors; (4) Torrens problems; (5) credit-related problems; and (6) survey problems. A title problem may fall into more than one of these categories at the same time. For example, a problem with the legal description on a sheriff’s certificate may be an error in a recorded document, a survey problem, a Torrens problem and a credit-related problem.
