“On June 30, 2015, the Department of Labor (DOL) released some long-anticipated proposed changes to the white collar overtime regulations under the Fair Labor Standards Act (FLSA). Salaried employees whose duties fall within the exemptions for executive, administrative, and professional employees and who earn at least $455 per week ($23,660 annually) are currently exempt from overtime pay. This is slated to significantly change. The DOL plans to fix the minimum weekly income required to qualify for exempt status at the 40th percentile of weekly earnings for all full-time salaried workers. If this proposal becomes the final rule and goes into effect sometime in 2016, the new minimum salary for exempt employees will be $970 per week or $50,440 annually. Plus, since the new minimum is fixed at a percentile of weekly earnings for all full-time salaried employees, employers should expect yearly increases of the minimum weekly salary.”
