Recent decision overturns decades old ruling.
In 1977 a ruling allowed public sector unions to charge nonmembers a fee being equal to the cost of dues that a union member would pay to offset the expense of collective bargaining, contract administration and grievances. In a close decision, SCOTUS now has ruled that government employees who don’t want to pair with a union can’t be forced to bear the cost of union fees. Steven M. Gutierrez advises Fortune 500 companies and small business owners regarding policies and practices relating to employment relationships. He handles civil rights litigation and discrimination claims made against non-profit organizations. Mr. Gutierrez works with companies in developing strategies to minimize complaints before they occur. He partners with senior management to implement in-house training, day-to-day counseling and to defend claims aggressively and successfully when they arise. Mr. Gutierrez is licensed in the United States District Court for the District of Colorado and the Tenth Circuit Court of Appeals. He is a member of the American Bar Association, the Colorado Bar Association, the Colorado Hispanic Bar Association, the National Hispanic Bar Association, Board Member of the Justice Information Center, Chair of the Employment Law Section of the Colorado Defense Lawyers Association and former Board Member of the South Metro Chamber of Commerce Economic Development Group. Mr. Gutierrez has spoken at various seminars and authored several articles and seminar materials involving topics related to the employer/employee relationship. He graduated from the University of Denver, College of Law (J.D. degree) and the University of Northern Colorado (B.A. degree).
