Overview and Nature of Colorado's Sales and Use Tax System

 
“The Colorado state sales tax originated with the passage of the “Emergency Retail Sales Tax Act of 1935.” In 1937, when the sales tax statute was first re-enacted, the Colorado General Assembly adopted the state use tax. The two impositions worked in tandem to levy a general 2% tax in a manner similar to the current sales and use tax system. Although these sales and use taxes have gone through several rounds of revisions, they remain the foundation of the present system. The state sales tax rate has increased almost a full percentage point and the revenues generated from the tax have become a vital source of income for the State of Colorado.”

“Colorado’s sales and use tax is an excise tax imposed upon the privilege of purchasing or using tangible personal property or benefiting from certain taxable services in Colorado. The tax is levied upon the transaction itself, as opposed to a tax on the property involved in the transaction.6 Unlike the payment of a property tax, the payment of an excise tax is made a condition precedent to the act, event, or occurrence upon which the tax is based.”
