Origin and Nature of Illinois Mechanics Liens

 
The primary purpose of the mechanics lien law is to provide a tool for contractors and other parties providing goods and services to a construction project to collect payment for the goods and services used in the project. The law generally provides that the contractor or other party shall have a lien against the construction project and land for the value of goods and services furnished. In Illinois, the law provides for recording of liens with the county recorder of deeds where the property is situated so that subsequent purchasers of the property are on notice of liens which may affect the property. The law also provides a mechanism for the contractor or other party to use to notify persons who have interests in the property of the lien and a means for collecting money owed under the lien through foreclosure proceedings.
