Ohio Employment of Minors, Tipped Employees, Deductions From Pay, and Frequency of Payments

 

“No minor of compulsory school age is permitted to be employed by any employer unless the minor presents a proper age and a schooling certificate as a condition of employment. O.R.C. §4109.02. A valid certificate constitutes conclusive evidence of the minor’s age and the employer’s right to employ the minor. 16 and 17 year old minors are not required to provide age and schooling certificates as a condition of employment if they are employed during summer vacation.

In Ohio, employers are required to thoroughly review the minor’s age and schooling certificate. O.R.C. §4109.03. Employers must also notify the superintendent within 5 days of when the certificate is no longer in use. Employers must not employ a minor with a void schooling certificate. Additionally, employers are not allowed to refuse to permit an enforcement official to observe the conditions which minors are employed. Also there must be an inquiry to the age of minors.”
