Minors Guardianship and Conservatorship in Arizona

 
Arizona Revised Statutes (ARS) § 14-5202 provides for the testamentary appointment of a guardian of an unmarried minor. The parent of a minor may appoint a guardian for that minor in the parent’s Last Will and Testament (“Will”). A surviving parent is the natural guardian of that parent’s minor children, and no appointment of the surviving parent as guardian is necessary. Charboneau v. Superior Court of Maricopa County, Ariz. , 101 Ariz. 586, 588, 422 P.2d 702, 704 (1967). The nominee of a deceased parent, when both parents are deceased, has priority over a relative, absent a finding by the court that appointment of the nominee would not be in the best interest of the minor.
