As a preliminary issue, an employer should review its workers’ compensation insurance policies to confirm that they will cover injuries arising out of home-based employment. This can be a particular problem with respect to telecommuters who may work out of state. Many insurance carriers will provide an all states endorsement to the policy, covering employees who may perform work out of state. This white paper reviews how the laws of some states may provide reciprocal coverage of varying degrees with respect to policies issued on behalf of employers from outside the state.
