Legal Ethics When Dealing With an Organization as a Client

 

Declining or Terminating Representation

An organization as a client has its own special issues. The primary rule regarding the organization as a client is contained in Rule 1.13, which states than a lawyer that is employed or retained by an organization represents the organization acting through its duly authorized constituents.

The general rule on declining or terminating representation is contained in Rule 1.16. The Rule states that except as stated in subsection (c), a lawyer isn’t allowed to represent a client or, where representation has commenced, has to withdraw from the representation of a client if the lawyer’s representation will end up in a violation of the rules of professional conduct or any other law…
