Kansas Medicaid at 10,000 Feet

 
Congress enacted Medicaid legislation "...for the purpose of providing federal financial
assistance to States that choose to reimburse certain costs of medical treatment for needy
persons." Harris v. McRae, 448 U.S. 297, 301 (1980). Medicaid is structured as a federal - state cooperative agreement. Williams v. Kansas Dept. of SRS, 258 Kan. 161, 899 P.2d 452 (1995).

While a state is not required to participate in Medicaid, once it elects to do so, it must comply with the Medicaid statutes and the regulations promulgated by the Secretary of the United States Department of Health and Human
Services (HHS).
