Illinois Construction Lien Law - Perfecting a Lien

 
A mechanics lien is a creature of statute and, in order to perfect the lien, the contractor and subcontractor must follow the statutory requirements. Perfecting the lien makes it valid against the property, and if the proper steps are taken in compliance with the statute, the lienholder may receive priority over not only the owner of the property but also third parties, such as mortgage lenders, in the event the property has to be sold at a foreclosure sale for the contractor to be paid on the lien. Under the statute, a distinction is made between contractors and subcontractors.
