Conducting an Effective Investigation

 

Review key issues when preparing for witness interviews.

Conducting an effective investigation could be the difference between providing the company an adequate defense in the event of a lawsuit and creating liability on behalf of the company. Courts generally do not require that the outcome of the investigation be perfect, only that it be supported by substantial evidence; and reasonably believed by the employer to be true. This white paper reviews why the investigation should be commenced as soon as possible, identifies which witnesses to interview and discusses what additional questions and matters to go over with the alleged wrongdoer.

  • Recently co-wrote a paper analyzing the California Fair Employment and Housing Council’s regulations on discrimination and harassment
  • Currently the amicus coordinator and a former chair of the Employers Group Legal Committee, a group of 18 prominent California lawyers who represent the interests of employers, as amicus curiae, in important employment and labor cases before the California and federal courts; in that capacity he was the author of a successful amicus brief in the important harassment case of Lyle v. Warner Brothers, in which the California Supreme Court addressed claims of environmental harassment involving the Friends television show
