Creditors may choose the remedies they want to pursue.
Creditor may collect on their claims under Florida’s Uniform Fraudulent Transfer Act after they have procured a decree from the court that the debtor, had in fact, made a fraudulent transfer. FUFTA affords creditors with assorted remedies and while the fundamental remedy under FUFTA is to set aside a fraudulent transfer, creditors may also be entitled to compensatory damages. Be that as it may, like any remedies under FUFTA, compensatory damages may be limited, or even unavailable, due to the equitable principles underlying the Act.
