Collecting a Judgment

Be certain to comply with the FDCPA if you intend to do any collection work.

Obtaining a judgment may seem easier than collecting it. Collection of debts typically requires compliance with the Fair Debt Collection Practices Act and attorneys qualify as debt collectors subject to those Acts. The use of a judgment and developing a plan to collect it can be complicated and perplexing. This white paper reviews the notice of demand to pay judgment, how to identify records and sources of information, and when to involve the court.
