Post-trial motions are a critical step in litigation.
Post-trial motions can be better vehicles than an appeal to effect a change in a judgment. They often are necessary to preserve certain issues for appeal. You likely will need to make a timely post-trial motion to preserve issues such as insufficient evidence to support the verdict; excessive or inadequate damages; and misconduct by the court, counsel, the parties, or a witness. This white paper reviews different types of post-trial motions and discusses traps for the unwary practitioner.
