Written Discovery at Trial, Use of Depositions and Voir Dire - the Paralegal's Role

 
Interrogatories in discovery are sworn statements that can be used at trial but in order to use for impeachment they need to be verified. When you receive interrogatory statements from the opposing side it is important to make sure you receive the verification as well. The original discovery needs to be filed with the court prior to the trial starting. Failure to receive the verification can render the testimony inadmissible. When working with requests for admissions the original needs to be filed with the court beforehand as well.

Our speaker, Marlo Orlin Leach, reviews the use of depositions at trial. Paralegals can work with the attorney ahead of time to summarize the transcripts and ensure page/line numbers are clearly marked for trial. She also discusses voir dire. Voir dire is very important but is not an easy process. There are a lot of verbal and nonverbal things that the paralegal can assist the attorney with to ensure they are choosing the best jurors.
