Workers' Compensation Initial Claims Analysis

 
In today’s workplace employers are dealing with ever increasing workers’ compensation costs. One aspect of attempting to control those rising costs is during the initial claims analysis. In this 36-minute video our speaker, James M. Mesnard, reviews the initial investigation and information gathering steps to determine as precisely as possible what happened. Once the initial investigation and fact gathering is complete, a decision must be made whether or not to accept and pay the claim. The final step is to return the injured employee to some type of workload. While most employees who sustain a work-related injury return to their job with no limitations within a short period of time; some are so severely injured that they are not able to return to their job. Mr. Mesnard covers these steps as well as the importance of assistance from a vocational counselor to assist employees in finding a job that fits within their work limitations.

James M. Mesnard is Of Counsel to the Washington, D.C. office of Seyfarth Shaw LLP. His practice focuses on defending employers in contested workers’ compensation claims, defending workers’ compensation retaliation claims in civil actions and administrative proceedings, and defending employers in lawsuits filed under various federal employment discrimination statutes. Mr. Mesnard was a law clerk to the chief administrative law judge for the U.S. Department of Labor where he helped prepare decisions on contested workers’ compensation claims arising under the Longshore and Harbor Workers’ Compensation Act.
