The work product privilege is really nota privilege, it’s a protection.
The attorney‐client is a privilege. The work product is a protection or an immunity, but it is not an evidentiary privilege. Work product doctrine and attorney-client privilege serve two different functions. The attorney-client privilege protects communications between attorneys and their clients, allowing the attorney to be perfectly candid in order to provide quality representation to the client knowing all of the facts. The work product doctrine is designed to protect the adversarial process.
