What Should You Do If You Encounter a Bidding Situation and the General Purpose of Bidding

 
If you encounter a bidding situation, you need someone who is extremely skilled to address your particular matter and in your particular jurisdiction. Generally the basic premise of bidding is to put all bidders on the same footing. If the bidding procedures or the received bids do not permit an apples to apples comparison, then the bidding process is unfair to the owner and bidders. Public bidding laws are biased in favor of the public. The goal behind public bidding laws is to protect the public. This goal typically gives significant leeway to owners. In the public context, the answer to the question “what is in the public’s best interest” is often outcome determinative; regardless of the good faith of the bidder.
