Discarding records in trash can is NOT proper destruction.
Medical records can only be legally destroyed when they are in excess of all required statutory periods. They must be destroyed by shredding, incineration, pulping, electronic deletion, pulverizing, magnetic degaussing or another equally effective protective measure. Destruction must be carried out in accordance with federal and state law pursuant to a written retention schedule or policy. This video reviews the importance of policies and procedures in both storage and destruction of medical records.
