Public's Right to Speak and Violations of Open Meetings Laws

 
Not all states grant the public the right to speak at open meetings. If they do, the public’s right to speak may be found in the state’s open meeting law or in another statute. Government‐sponsored forums for speech and the First Amendment are incorporated to the states via the Fourteenth Amendment. Open meetings laws might prohibit, allow or require public forum at open meetings.

In this 25-minute video our speaker, Maryam Judar, discusses different state laws on these matters. She reviews what can happen if an open meetings law is violated which include disciplinary actions, cures, civil penalties, criminal penalties, potential jail time, and attorney fees. Ms. Judar delves in to details on each of these possibilities by providing information on case law.

Maryam Judar is the executive director and a community lawyer at the Citizen Advocacy Center in Elmhurst, Illinois. She practices in the arenas of sunshine laws and laws supporting public participation including the First Amendment, ballot access, campaign finance, redistricting, and civic education. Ms. Judar was nominated to the state legislative Task Force on Civic Education in 2013, which resulted in the passage of legislation bringing civic education back to Illinois high schools as a graduation requirement.
