Privacy Obligations Under Collective Bargaining Agreements

 
Privacy obligations are becoming more of an issue for employees to deal with through collective bargaining agreements (CBA). There are federal and state laws governing workplace privacy and there may be specific provisions on monitoring that are reflected in the CBAs, however typically disputes in any way arising under a CBA must go through the grievance and arbitration process. There have been some cases where an employee’s state law privacy rights are not completely preempted and therefore not necessarily a CBA matter. However unions are taking the lead from the NLRB’s action to become very active in this area.

Our speakers, L. Julius M. Turman and Eric M. Walder, review areas where activity is considered a close call such as when an employee’s actions happen outside of working hours or when the employer does not have a policy that prohibits using company equipment for personal use.

L. Julius M. Turman is a Partner in the San Francisco office of Reed Smith LLP. His practice emphasizes all aspects of labor and employment law, including both counseling and litigation. Mr. Turman is a former U.S. attorney with extensive trial experience. He conducts regular seminars and workshops on the full spectrum of employment law issues. Mr. Turman has written numerous publications and frequently cited by the press on issues related to employment law.

Eric M. Walder is an attorney in Reed Smith's Commercial Litigation group and is based out of the San Francisco office. His practice includes a variety of employment matters including the defense of discrimination, retaliation, harassment, and wrongful termination claims. Mr. Walder provides advice and counsel to employers in connection with California’s ever-evolving employment laws.
