Preventative Collection - Collecting Without Filing a Lawsuit

How do you collect without filing a lawsuit? One of the best ways to ensure collection in the future is to have the debtor complete a sufficiently detailed application for credit. This may seem like a no-brainer but there are some that don’t complete this step and find themselves wishing they did. If the information on the application is provided, particularly information about bank accounts, you can often effectuate your own collections in a fairly streamlined fashion.

In this video our speaker, Mollie Pawlosky, reviews specific areas to emphasize for a detailed credit application. She discusses what information to obtain and verify for a corporation or business entity, as well as considering obtaining security interest. The better the written agreement means the better the ability to collect. It sounds simple but a lot of times people don’t cross the T’s and dot the I’s and they regret it. Ms. Pawlosky explains the importance of tailoring your agreements as much as possible to your relationship with the debtor.

Mollie Pawlosky is a shareholder with Dickinson Mackaman Tyler & Hagen, P.C. Her practice emphasizes all aspects of commercial litigation, collections and foreclosures. She has been selected for inclusion in the 2016 edition of Best Lawyers in America in bankruptcy and creditor debtor rights/insolvency and reorganization law.
