Planning an Effective Collection Strategy

 
Assuming that despite all of your best efforts your customer is not paying in a timely manner. How do you know when to file suit? In order to collect the debt you need to communicate first. Be persistent, polite and clear with expectations. Send a final written demand, possibly from legal counsel. Consider whether the courts of your home state have jurisdiction, or if you need to file in the customer’s state. Determine if a small claims court is available? Can you recover attorneys’ fees and costs, in addition to the invoice balance? You need to watch the statute of limitations (deadline for filing suit).

In this 16-minute video our speaker, Robert W. Pontz, reviews how to identify the defendants by referring to the credit application, reviewing invoices and payment history, and determining who is liable on the debt among others. He compares the difference between obtaining a money judgment vs. enforcement of property rights. Mr. Pontz wraps up this video by evaluating piercing and reverse-piercing the corporate veil.
