Paralegal's Role During the Trial

The paralegal’s role during the trial covers a variety of different tasks. Opening statement requires notes taken as to what is promised as to evidence, and then watching the jurors reaction during that statement. During direct and cross examination noting key testimony and key omissions is valuable to the attorney during the closing statement. Tracking the exhibits and objections are important as well. The paralegal is also the eyes during the trial to take note of the juror’s and judge’s reactions.

Our speaker, Marlo Orlin Leach, reviews the importance of charts to keep during the trial. They will include key evidence from the trial such as exhibit numbers, Bates number, name of witnesses, brief descriptions, deposition references, objections, admitted/excluded/tabled items, stipulated facts and stipulated documents. During each day, the paralegal notes the exhibits used and to be admitted and before the close of case, they can ensure all have been admitted.

Marlo Orlin Leach is a managing member of Leach and Lowe LLC. She focuses her legal practice on tort, commercial, and environmental litigation. She defends premises and product liability actions involving property damage and personal injury, including claims based on toxic torts, indoor air quality, and the manufacture and use of tools, machinery, and chemicals.
