The FLSA applies to most employers. There are two types of coverage: enterprise coverage and individual coverage. Covered entities are required to pay nonexempt employees overtime at a rate of time and one half an employee’s regular rate, including all non?excludable compensation, for all hours worked in excess of 40 hours in a work week. This video reviews FLSA exemptions and who is exempt and explains the regular rate vs. the hourly rate and how to calculate the regular rate.
