New CAM Charges, Including Landlord Green Initiatives

 
“Multiple standardized rating systems exist that evaluate the ‘green’ qualities of a building (a ‘Green Building’), including U.S. EPA’s Energy Star, the Green Building Initiative's Green Globes for Continual Improvement of Existing Buildings, and the U.S. Green Building Council’s Leadership in Energy and Environmental Design, sometimes referred to as LEED. In general, Tenants with net lease in a Green Building should realize a savings in operating expenses compared to a non-Green Building. However, the Tenant’s savings may be offset because: (i) they may pay a premium for space in a Green Building, and (ii) a Green Building will likely include some operating expenses that are unique to a Green Building, largely attributable to costs associated with Green Building Standards compliance.”

Marc H. Goldsmith, Counsel with McGuireWoods LLP’s Los Angeles, CA office. His practice focuses on commercial leasing and commercial real property purchase and sale transactions, as well as condominium law. He is responsible for negotiating, drafting and reviewing various real estate contracts for retail, office and industrial uses, including leases, purchase/sale agreements, easements, licenses, deeds of trust, subordination agreements, and amendments. Mr. Goldsmith serves as general corporate counsel to numerous nonprofit homeowners associations, business and mixed-use condominium associations, timeshare associations, and for profit entities.
