Nature of the Employment Relationship

 
When you say that you employee somebody, what does that actually mean in legal terms? While our speaker describes this from the private employer perspective, the same principles can also apply to public employers. The way that a lawyer thinks about the employment relationship is that it would be generally called a unilateral contract. The terms and conditions of employment are controlled by one side and the other side either accepts or rejects those conditions.

In this 14-minute video our speaker, Calvin R. House, Esq., reviews employment-at-will and explains that, regardless if it is a public employer or private employer, the while an employer is free to end the employment relationship at any time, there actually are constraints on the employer. There are almost no constraints on the employee. The employee is entitled to the benefits and salary that was promised when they started the employment. If the employer acts against the employee for an unlawful reason then it can be held to account for letting the employee go, not promoting them, or taking some other adverse action against them.
