Lying Clients in Court

 
Do clients lie in court or is it simply that they actually believe their facts to be true? The first rule regarding honesty in court proceedings is Rule 3.1 which requires that a claim or a contention be meritorious. Our speaker, John A. Snow, states that most people look at this rule as though you can not file a frivolous lawsuit … but it goes much broader than that.

Rule 3.3 deals with candor towards the tribunal. Mr. Snow says that candor is a bit of an understatement as the rule requires absolute truthfulness. He explains that a lawyer may have filed a brief where a case was cited and then learn after the filing that the case was overruled. Lawyers have an obligation to make sure that the court is aware that the statement was in error. Lawyers always have an obligation to correct any misstatements of fact.

In this 20-minute video, Mr. Snow discusses court cases that deal with these rules as well as Rule 3.4 .
