Issuance of Final Rule Updating OFCCP's Sex Discrimination Guidelines

 
Not too long ago the OFCCP issued a final rule relating to sex discrimination. What is notable about this is that this final rule – Discrimination on the Basis of Sex – updates the OFCCP’s Sex Discrimination Guidelines for the first time in more than 40 years and makes a regulation as opposed to guidance. As you can imagine the law has changed significantly over that 40 year period. This regulatory update purports to represent the 40 years of both case law interpreting the nondiscrimination requirements of Title VII and Executive Order 11246; as well as the EEO Enforcement Agency’s interpretation of those laws. This final rule is intended to align contractor requirements with well-established case law and federal agency interpretation of federal EEO laws. The new regulation was designed to addresses pervasive problems – including wage disparities, pregnancy and caregiving discrimination and sex-based stereotyping – through recommended best practices.
