The basics for informed consent for treatment were decided back in 1914 in a SCOTUS case.
Justice Cordozo decided that each competent person has the right to make the decision concerning their own health care; and if the care provided was contrary to the competent patient’s wishes then that can be considered an assault. This video reviews the general principles of consent, consent requirements and liability, and what happens when there is a lack of informed consent.
