Most states have adopted the general framework of federal depreciation and amortization rules.
The general tax treatment of software is defined under federal Internal Revenue Code (IRC) as all programs designed to cause a computer to perform a desired function. This includes any database or similar item that is in the public domain and is incidental to the operation of qualifying software. The variations in treatment among states for income/franchise tax are minor compared to sales and use tax. Nearly all states imposing a tax on net income incorporate the IRC’s software provisions directly or follow them in some form.
