How to Manage Applicant Data Associated with Job Fairs, College Recruiting, Employment Agencies and New Technologies

There are some unique situations surrounding recruitment that can turn the OFCCP’s regulation on its head a bit or at least make it little more difficult for you to comply. Those situations include career fairs and employment agencies. With the use of employment agencies or third party recruiters – whose responsibility is recordkeeping? The OFCCP says it is the contractor’s obligation to make sure its vendors keep records and otherwise follow the rules. However, the obligations cannot be delegated.

What about job fairs? Are all candidates from on-campus recruiting Internet applicants? What about candidates who are directed to apply through the Internet, but do not?

In this 8-minute video our speaker, Matthew J. Camardella, reviews the answers to these questions. He discusses the impact of new technologies on recordkeeping requirements. Mr. Camardella also talks about the constant flow of new tools for recruitment and selection available online and how the regulation did not anticipate these technological advances and do not address their use.

Matthew J. Camardella is a Principal in the Long Island, New York office of Jackson Lewis P.C. He practices almost exclusively in the area of federal government contractor compliance with affirmative action requirements. Mr. Camardella conducts regular seminars and workshops on numerous topics related to affirmative action and OFCCP. He wrote several publications related to the areas of affirmative action and systemic discrimination.
