Historical Perspectives - Pre-Fair Debt Collection Practices Act (FDCPA)

 
From a historical perspective, pre-Fair Debt Collection Practices Act goes back quite some time. The Fair Debt Collection Practices Act was first passed in 1977 by the United States Congress. However, long before then there was a need for collecting consumer debts. There were some limits that the courts and the law imposed on harassing conduct by debt collectors. Tort claims arising out of abusive collection conduct included egregious conduct required to impose liability, tort of invasion of privacy (intrusion upon seclusion, disclosure of private facts), intention of emotional distress (conduct beyond bounds of human decency), and tort of outrage.

In this 13-minute video our speaker, Ronald S. Canter, reviews state laws on debt collection practices, including laws directed to intentional conduct. Mr. Canter also discusses State unfair and deceptive trade practices acts.
