HIPAA doesn't have to stand in the way of employer access.
According to HIPAA, information that is protected is “individually identifiable health information.” This can be details that relate to an individual’s physical or mental health at any time, or treatment to an individual, or payment for the provision of health care to an individual at any time, provided it identifies an individual or could identify an individual. Because employers interact with health care providers this rule places restraints on the health care provider’s ability to give information to the employer absent an agreement by the employee. This video reviews an exclusion to this rule and discusses a permitted disclosure.
