Essential Commercial Lease Provisions

 
A lease conveys an interest in real estate; i.e., the right to occupy the leased premises for the term specified in the lease. A lease also sets forth the terms of an ongoing contractual relationship between the landlord and tenant. This duality manifests itself in the lease documentation. Pre-drafting considerations should include basic questions which must be answered and factors to be considered prior to drafting the lease. They will in part determine its terms and may in fact indicate that the planned use of the premises by the tenant is not feasible or that the proposed deal requires modification.

In this 51-minute video our speaker, David J. Tracy, reviews situations between landlords and tenants in that a landlord can grant to the tenant only those rights in the real estate which it possesses. The tenant should require confirmation of the landlord's title by an express warranty of title, title examination, title certification and/or title insurance. Mr. Tracy also discusses the parties and authority to contract and extension options.
