Employee Handbooks

The practice can vary widely when creating employee handbooks. From private to public employers, small to large size business - make sure you have a handbook that contains all the important policies. Steps to implementation of an employee handbook includes developing policies, drafting provisions, legal reviews, obtaining employee acknowledgements, and keeping it up-to-date annually.

In this 10-minute video our speaker, Calvin R. House, Esq., reviews these simple steps to getting yourself an employee handbook. There is one particular issue with regard to employee handbooks and policies that he also discusses - arbitration. It is common wisdom that when there is a dispute with an employee, arbitration is preferred rather than getting dragged into a lawsuit. Arbitration is usually unreviewable. If an arbitrator says you violated an employee’s rights, the rule is final and can’t be challenged. If you do go to trial and a jury decides that you violated an employee’s rights, you have two chances to change the outcome. Choose wisely when deciding between arbitration vs. trial.

Calvin R. House, Esq. is a partner in the Pasadena, California law firm of Gutierrez, Preciado & House, LLP, where he defends and counsels employers on employment law matters. He has tried scores of employment cases to federal and state juries and judges, and administrative tribunals. Mr. House conducts regular seminars and workshops on such employment law topics, as wage and hour requirements, mandatory leave statutes, reasonable accommodation of disabilities, discrimination, harassment and wrongful termination.
