Delay is an issue which is consistently present in construction cases. Typically, each side produces an expert at trial to present its view of who delayed the project and what the impacts of that delay were. This material looks at some case law regarding who has the burden of proof on the issue of delay and how that burden of proof can be met. The burden of proof isn’t something that the other side has therefore you don’t have any responsibility for it and don’t need to pay attention to it. The burden of proof is very important but you also want to have an understanding of the facts and the law to make sure you can defend against claims from parties that do have the burden of proof.
