Depositions: Determining Hearsay and Exceptions to Hearsay

 

Identify errors or irregularities that may prompt an objection.

A statement made by a witness may be introduced at trial for any proper purpose. These statements are useful in settlement negotiations, impeachment, and for shedding light on facts that may be unclear. Opposing party’s statements are able to be introduced at trial and the opposing party may take the stand to defend their prior statements if they wish. There are some objections that must be made at the deposition: if it relates to the manner of the taking of the deposition, the form of a question or answer, the oath or affirmation, a party’s conduct, or other matters that might have been corrected at that time. This video reviews the importance of determining what is hearsay and what is not during the deposition and discusses the use of the deposition in settlement negotiations and trial.
