Defending Workers' Compensation Claims: Preparation for the Hearing and Conduct of the Hearing

 
Complete and accurate medical records are essential to the defense of a case. Moreover, the medical records provide the employer, counsel and other health care providers with the history of treatment received by the employee. The medical records may also reflect inconsistencies that can be used to attack the claimant’s credibility. In this 23-minute video our speaker, James M. Mesnard, reviews steps to prepare for the hearing, including, obtaining medical documentation, written discovery, depositions, and witness preparation. He also discusses the presentation of medical records during the hearing. The heart of a workers’ compensation hearing is the claimant’s testimony. Mr. Mesnard discusses his method of questioning during the claimant’s testimony, the use of surveillance, and the presentation of vocational evidence.

James M. Mesnard is Of Counsel to the Washington, D.C. office of Seyfarth Shaw LLP. His practice focuses on defending employers in contested workers’ compensation claims, defending workers’ compensation retaliation claims in civil actions and administrative proceedings, and defending employers in lawsuits filed under various federal employment discrimination statutes. Mr. Mesnard was a law clerk to the chief administrative law judge for the U.S. Department of Labor where he helped prepare decisions on contested workers’ compensation claims arising under the Longshore and Harbor Workers’ Compensation Act.
