Arbitration and mediation are very different. It is very important and the beginning of a dispute to understand if there is a contract that may require the parties to arbitrate and, if there is, what does it provide, what are the requirements, the parameters? Conversely, if there is not an agreement between the parties, it is important to consider drafting a post-dispute contract anticipating there could be a dispute down the road. This video reviews the importance of understanding if a contract is binding before you enter into it and discusses the scope of arbitration.
