Deciding Whether to Pursue Collections

 
Why is it important to consider other collections efforts or types of collections options before filing a lawsuit? Lawsuits are the most expensive alternative available to a creditor. From the attorney’s fees to the cost of eDiscovery it’s certainly going to be costly to file a lawsuit. However, those costs aren’t always the biggest impediment. You could end a business or customer relationship that you are dependent upon. Also, a lawsuit could invite a debtor to file a counterclaim depending on the nature of the relationship. Pre-suit collection efforts can help give the creditor information about collection of a debt which would allow the creditor to decide if the suit should ultimately be filed.

In this video our speaker, Mollie Pawlosky, reviews goals of compelling payment of debt. She discusses basic element of cost-benefit analysis of collection efforts to make sure you are making the best decision. Ms. Pawlosky reviews other elements to consider on how to approach handling debt collection.
