When a construction contract first comes into being there is an intent for it and then purposeful creation of the contract. There can be a competitive bid or a negotiation between the parties before the execution of any documents that finalizes the agreement. However, there are situations that arise where attorneys find that there is a blind boilerplate purchase order that gives rise to the arrangement, that is rarely done by contract negotiation, which brings up the battle of the forms.
