Conflicts of Interest for Transactional Attorneys

 
John A. Snow, attoney at Prince Yeates, discusses the conflicts of interest associated with transactional attorneys. The conflict rules are designed to promote loyalty of the lawyers and to put the interest of the client above that of the lawyer. Snow discusses the three basic rules that address conflicts of interest pertaining to existing clients, former clients, and conflicts that exist because of the type or subject matter of the contemplated transaction or relationship. Snow breaks down the meaning and examples of each rule.

Rule 1.7 deals with current clients. Snow gives examples of when you might run into a conflict of interest and ways that it can be avoided. For example, if each affected client gives informed consent, confirmed in writing. He explains the purpose of current clients’ waiver of future conflicts, when it can be used and how it is effective. Rule 1.9 addresses duties to former clients. There are certain prohibited transactions that Snow explains that are associated with the third basic rule, Rule 1.8.
