Conducting the Review Based Upon Operational Oversight Versus Attorney Oversight

 

Communication varies between the two types of oversight.

As long as the attorney has the oversight then anything that is instructed by the attorney with respect to the billing issue can be protected by the attorney/client privilege. However, the underlying facts are not protected, it is how they are conducting the review that is protected. Under operational oversight of the entity, the communication occurs at a lower level in the organization; unless it’s a bigger situation and the higher level executives need to be involved. This video reviews these two type of oversight and how results are shared.
