Why is Notice important?
Notice is important because it is the owners’ first line of defense when denying a claim. The notice requirements in a contract can sometimes be very onerous and if you don't follow those notice requirements the owner may deny the claim without even considering the merits of the claim. That is particularly important when dealing with public entities because they don't have an enrichment or implied contract remedies that you can go after them for so if you aren't following the contract you can be in trouble when go to assert those claims in court. This video reviews strict compliance vs. substantial compliance in notice requirements and discusses the cost of noncompliance.
